Terms and Conditions


1. ACCEPTANCE OF TERMS 

These terms and conditions ("Terms and Conditions") govern the relationship between MPS Creations LLC doing business as Embody Luxe Experiences ("ELE," "we," "us," or "our") and you, the purchaser or traveler ("Client," "participant," "passenger," and "you/your"). 

By planning travel with ELE, accessing our website (www.embodyluxeexperiences.com), or booking any retreat, you agree to be bound by these Terms and acknowledge that ELE acts solely as a booking agent for disclosed principal supplier tour operators, hotels, airlines, ground transportation, wellness instructors, and other independent contractors providing accommodations, transportation, wellness services, and other services ("Supplier(s)") and is not the source or provider of the travel services. 

These Terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to ELE. 


Business Structure: Embody Luxe Experiences is operated by MPS Creations LLC, a Michigan Limited Liability Company, in collaboration with TheTeacherChelsea LLC for wellness programming and instruction. 


Seller of Travel Registration: MPS Creations LLC is an Independent Contractor of WorldVia Travel Network, California Seller of Travel 2073234-00, Florida ST36257, Washington 602864166. Registration as a seller of travel does not constitute approval by the State of California. 


2. USE OF ELE SERVICES AND BOOKING AUTHORITY 


2.1 Legal Capacity and Age Requirements 

You warrant that you are at least 25 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with ELE. Participants under 25 require special approval. You agree to be financially responsible for all travel bookings you make with ELE, whether made on behalf of yourself or for other members of your traveling party. 


2.2 Accuracy of Information 

You warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with ELE is true and accurate. You agree that you will only make legitimate reservations or purchases with ELE and its Suppliers, and you acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited. 


2.3 Agency Relationship 

ELE accepts all bookings solely as the booking agent for the travel Suppliers and wellness service providers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree that by booking travel through ELE, you are also agreeing to the booking terms of each Supplier partner you have selected for your itinerary. 


2.4 Independent Arrangements 

ELE is not liable or responsible for any arrangements made independently of ELE. ELE assumes no responsibility for costs or fees you incur for independent arrangements not booked through ELE, inclusive of, but not limited to, airline, hotel, excursion, and travel protection related charges. If you make your own flight arrangements, ELE is not responsible for any loss resulting from cancellation or changes in itineraries or travel dates. 


3. RETREAT BOOKINGS AND RESERVATIONS 


3.1 Booking Process 

  • All retreat bookings must be made through www.embodyluxeexperiences.com or by contacting info@embodyluxeexperiences.com 
  • A booking is confirmed only upon receipt of the required deposit payment 
  • You will receive a booking confirmation email within 24-48 hours of payment 
  • Retreat capacity is limited to 10-16 participants per retreat 


3.2 Payment Schedule 


Standard Payment Terms: 

  • Deposit:$500  due at time of booking 
  • Second Payment: 50% of remaining balance due 60 days prior to retreat start date 
  • Final Payment: remaining balance due 30 days prior to retreat start date 


Payment Plans: 

  • Payment plans available with automatic monthly charges 
  • $50 payment processing fee applies to all payment plans 
  • Authorization for automatic credit card charges required 
  • All payments must be completed 30 days before retreat start date 
  • Missed payments may result in booking cancellation 


3.3 Payment Methods 

  • Major credit cards accepted (Visa, Mastercard, American Express, Discover) via Stripe 
  • A payment processing fee applies to all transactions (pass-through to customers) 
  • All prices in US Dollars (USD) 
  • By submitting payment authorization, you agree to allow ELE to purchase travel products from Suppliers on your behalf 


3.4 Payment Obligations 

All payments for travel are due prior to departure according to the payment schedule. Failure to make final payment or any violation of booking conditions may result in cancellation of your reservation, denial of access to the retreat, or forfeiture of any monies paid. 


EXCEPTING IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF ELE OR ITS SUPPLIERS. 


4. PRICING AND FEES 


4.1 Retreat Pricing 

All prices listed on our website and confirmed at booking are guaranteed and will not increase. Prices subject to change for future bookings. 


4.2 All-Inclusive Package Inclusions 


Included in Retreat Price: 

  • Accommodation (shared double occupancy; single supplement available) 
  • Meals: breakfast and lunch and farewell celebration dinner 
  • All wellness programming and flexibility training sessions led by certified instructors 
  • Merchandise package: Custom retreat apparel, wellness tools, commemorative items 
  • Ground transportation: Airport transfers 
  • One signature cultural experience per international destination 
  • Welcome & closing ceremonies  



4.3 Exclusions 


NOT Included in Retreat Price: 

  • Flights to/from retreat destination 
  • Travel insurance (strongly recommended) 
  • Alcoholic beverages (except welcome/farewell toasts) 
  • Spa treatments or additional personal services 
  • Personal shopping and souvenirs beyond included merchandise 
  • Meals outside programmed group dining 
  • Tips and gratuities for local guides and service staff 


4.4 Shared Room Policy and Participant Responsibility 


For shared accommodations, each participant is responsible for their portion of the room cost. If a roommate cancels, the remaining participant agrees to one of the following options:
(a) accept a new assigned roommate if one is available,
(b) upgrade to single occupancy and pay the applicable supplement, or
(c) provide a replacement participant to assume the canceled spot.


Room costs associated with shared accommodations are non‑refundable once room assignments are made due to fixed fees.


5. CANCELLATION AND REFUND POLICY 


5.1 Participant Cancellations 

All cancellation requests must be submitted in writing to info@embodyluxeexperiences.com 


All cancellations are subject to a $150 ELE administrative fee, which will be deducted from any applicable refund amount. The deposit will be non-refundable if your cancellation reduces the total number of participants below the required minimum of 10 and your spot cannot be filled after cancellation.


Refund Schedule: 

  • 90+ days before retreat: Full refund minus $150 fee 
  • 60-89 days before retreat: 75% refund minus $150 fee 
  • 30-59 days before retreat: 50% refund minus $150 fee 
  • Less than 30 days before retreat: No refund 


Travel insurance strongly recommended. 


5.2 Retreat Transfer Policy 

Participants may transfer booking to future ELE retreat with following conditions: 

  • $50 administrative change fee applies 
  • Transfer requested at least 30 days before original retreat date 
  • Transfer subject to availability in future retreat 
  • Price difference may apply if future retreat more expensive 


5.3 ELE Cancellations 

ELE reserves right to cancel any retreat due to: 

  • Insufficient enrollment (minimum 10 participants required) 
  • Force majeure events (see Section 18) 
  • Safety concerns or travel advisories 


If ELE Cancels Retreat: 

  • Full refund of all payments made 
  • Refunds processed within 14 business days 
  • ELE not responsible for non-refundable expenses incurred independently (flights, accommodations) 


5.4 Changes to Bookings 

If you decide to change any portion of confirmed arrangements prior to departure or during your trip, ELE will attempt to assist. Certain bookings may not be able to be changed. All change requests must be made in writing to info@embodyluxeexperiences.com. You will be responsible for any increases in cost imposed by Suppliers and any ELE or Supplier change fees. 


6. CHARGEBACKS AND PAYMENT DISPUTES 

ELE processes payments on behalf of Suppliers and acts as booking agent in accordance with industry standards. By authorizing payment through ELE, you acknowledge and agree to the following: 


Before Initiating Chargeback: You agree to first attempt to resolve any disputed transaction fees directly with ELE in writing at info@embodyluxeexperiences.com. ELE will make reasonable efforts to investigate and respond within a reasonable timeframe. 


Prohibited Chargebacks: You agree that chargebacks, payment disputes, or credit card reversals may only be initiated in cases of actual fraud or unauthorized transactions. You expressly agree NOT to initiate chargebacks for: (1) dissatisfaction with travel services provided by Suppliers; (2) changes to itineraries made by Suppliers due to weather, mechanical issues, or circumstances beyond ELE's control; (3) cancellation of travel due to personal circumstances, illness, or reasons covered by travel insurance; (4) failure to travel due to documentation issues, visa denials, or personal circumstances; (5) any reason related to quality, delivery, or cancellation of services provided by third-party Suppliers. 


Consequences of Unauthorized Chargebacks: IF YOU INITIATE AN UNAUTHORIZED CHARGEBACK IN VIOLATION OF THESE TERMS, ELE RESERVES THE RIGHT TO: (1) immediately cancel any current or future travel bookings; (2) pursue collection of all amounts due, including original transaction amount, chargeback fees, administrative costs, and reasonable attorney fees; (3) report chargeback abuse to relevant industry databases; (4) refuse future service. 


7. PARTICIPANT REQUIREMENTS AND ELIGIBILITY 


7.1 Age Requirements 

  • Minimum age: 25 years old 


7.2 Health and Fitness Requirements 

  • Participants must be in reasonably good health to participate in physical activities 
  • Must disclose any medical conditions, injuries, or limitations that may affect participation 
  • ELE reserves right to refuse participation if health/fitness concerns exist 
  • Modifications to physical activities available for individual needs 


7.3 Required Documentation 

All participants must complete and submit prior to retreat: 

  • Signed liability waiver and release form 
  • Health questionnaire 
  • Emergency contact information 
  • Dietary restrictions and allergy information 
  • Travel insurance information (if applicable) 


7.4 Travel Requirements for International Retreats 

  • Valid passport required (must be valid 6+ months beyond travel dates) 
  • Participants responsible for obtaining necessary visas 
  • Compliance with all destination country entry requirements 
  • Certain countries may require specific health screenings or vaccinations 


8. TRAVEL DOCUMENTS AND IDENTIFICATION 


8.1 Participant Responsibility 

It is your responsibility to obtain and carry valid passport, visa(s), and all other documents required by applicable government regulations. Passport cards are not accepted for most international travel. 


8.2 TSA and DHS Requirements 

U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) require acceptable identification to board flights. Acceptable identification includes DHS-designated enhanced driver's license, U.S. passport, or foreign government passport. Information available at www.tsa.gov. 


8.3 Passport Validity 

Certain countries will not admit passengers if passport expires within six (6) months of anticipated return date. ELE neither controls nor warrants issuance of visas or approval of visa waivers. Should visa not be issued, ELE is not responsible for lost payments. 


8.4 Document Accuracy 

Name, date of birth, and gender on identification must exactly match data on tickets and booking records. You acknowledge responsibility to ensure information on tickets and confirmations is accurate. Any discrepancy may result in denied boarding or delays. 

WHEN YOU RECEIVE TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT ELE IMMEDIATELY IF CHANGES REQUIRED. IF YOU HAVE NOT NOTIFIED ELE OF NECESSARY CORRECTIONS WITHIN TWENTY-FOUR (24) HOURS OF RECEIVING DOCUMENTS, ELE BEARS NO RESPONSIBILITY FOR ADDITIONAL COSTS. 


8.5 Criminal Records and Entry Requirements 

Countries hold different views of past criminal offenses. If you have current or prior criminal offense, contact destination country directly for entry/exit requirements. Visit U.S. State Department website (travel.state.gov) for information. ELE does not inquire about criminal records in interest of respecting client privacy. 


9. IMMUNIZATIONS AND HEALTH SCREENINGS 

You must have proper immunizations, health screenings, and required documentation before travel. ELE shall not assume responsibility for accuracy of health, vaccination, or documentation requirements prior to departure or upon landing. 

In some cases, required inoculations must be recorded on valid vaccination certificate. Check State Department website (travel.state.gov) and Centers for Disease Control (wwwnc.cdc.gov/travel) for health issues related to travel. 

If concerned about medications or inoculations, check with health practitioner BEFORE booking. 


10. ACCESSIBILITY AND SPECIAL NEEDS 


10.1 Advance Notice Required 

Travelers with disabilities or special needs who may require non-emergency special services, additional support, or accommodation should advise ELE in advance of booking, so ELE can request assistance or arrange appropriate services or equipment. 


10.2 Equipment and Services 

In some cases, rental of special equipment or devices may result in additional charges. Airlines may impose charges for additional baggage and may have restrictions on wheelchair size. 


10.3 Service Animals 

To travel with service animal or emotional support animal, some Suppliers may require advance arrangements and special documentation of animal's health and training. 


10.4 International Standards 

When traveling outside United States or Canada, laws and regulations often apply different standards of accommodation for travelers with disabilities or special needs. While ELE is committed to assisting travelers with disabilities, ELE is not responsible for failure of Suppliers to meet needs when Supplier follows laws and regulations of local jurisdiction. 


10.5 Medical Facilities 

Certain destinations may have limited medical facilities or limited availability of prescription medications. ELE recommends consulting with health practitioner to discuss trip details. Certain travel insurance plans may provide access to emergency medical care, medical evacuation, and replacement of prescription medication. 


11. TRAVEL INSURANCE 


11.1 Strong Recommendation 

ELE STRONGLY RECOMMENDS THE PURCHASE OF COMPREHENSIVE TRAVEL INSURANCE ON ALL BOOKINGS. Unless specifically noted, travel insurance is NOT included in retreat cost. 


11.2 Coverage Areas 

Proper insurance may protect against financial loss for: 

  • Trip cancellation and interruption 
  • Medical emergency transportation/evacuation & repatriation 
  • Supplier default/bankruptcy protection 
  • Baggage & personal effects/lost luggage & baggage delay 
  • Illness and medical expenses 
  • Change of plans 
  • Accidental death and disability 


11.3 Insurance Partners 

ELE has affiliate relationships with two insurance brokers who can provide travel insurance. Information and quotes available upon request at info@embodyluxeexperiences.com. 


11.4 ELE's Limitation 

Without appropriate travel insurance, if you cancel or interrupt travel for any reason, portions of trip may not be refunded and ELE's and Suppliers' cancellation penalties will apply, resulting in loss of monies up to full cost of travel booking. 


11.5 No Insurance Broker License 

ELE is not licensed insurance broker and is not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of insurance offered, nor evaluate adequacy of prospective insured's existing insurance coverage. ELE CANNOT GUARANTEE THAT ANY INSURANCE PROVIDER WILL APPROVE COVERAGE FOR CLAIM AND MAKES NO REPRESENTATIONS ABOUT EXTENT OF COVERAGE. 


12. RISKS AND SAFETY 


12.1 Inherent Risks 

Travel to certain destinations may involve greater risk than others. Certain activities included as part of retreat itineraries pose inherent risks and may be dangerous. Your itinerary may involve travel to remote areas without access to medical facilities, changing weather conditions, interactions with wildlife, and other potentially dangerous conditions. 


12.2 Physical Exertion Acknowledgment 

By booking trip with ELE, you acknowledge awareness that physical exertion required to participate in certain activities can activate or aggravate pre-existing injuries, conditions, or congenital defects. You acknowledge you should seek medical advice if you know or suspect physical condition may be incompatible with itinerary activities. 


12.3 Safety Equipment 

You may be required to wear approved safety equipment while participating in certain activities. By booking travel and participating in activities, you agree to use recommended safety equipment and ask questions if unsure about proper or safe use. 


12.4 Alcohol and Drug Policy 

If you use, consume, or are under influence of alcohol or illegal drugs prior to or while engaging in any activities, YOU ASSUME AND ACCEPT ALL RISKS, DANGERS, AND HAZARDS THAT MAY RESULT INCLUDING POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS, even in event of negligence by ELE or third parties, and you indemnify ELE from any and all liability. 


12.5 Government Advisories 

ELE urges Clients to remain informed on daily basis as to current news events, and to review travel prohibitions, warnings, announcements, and advisories issued by United States Government prior to booking international travel. Information available at www.state.gov, www.tsa.gov, www.cdc.gov, and www.cbp.gov. 

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, ELE DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. 


13. LIABILITY WAIVER AND ASSUMPTION OF RISK 


13.1 Acknowledgment of Risks 

Participants acknowledge retreat activities involve inherent risks including but not limited to: 

  • Physical activity and exercise-related injuries 
  • Travel to domestic and international destinations 
  • Exposure to different climates and environments 
  • Participation in cultural activities and excursions 


13.2 Release of Liability 

By participating in ELE retreats, participants agree to: 

  • Assume all risks associated with participation 
  • Release ELE, MPS Creations LLC, TheTeacherChelsea LLC, and their employees, contractors, and partners from liability 
  • Not hold us responsible for injury, illness, loss, or damage occurring during retreat activities 


13.3 Medical Authorization 

Participants authorize ELE staff to: 

  • Obtain emergency medical treatment if necessary 
  • Share relevant health information with medical professionals 
  • Make decisions in participant's best interest during medical emergencies 


14. CODE OF CONDUCT 


14.1 Expected Behavior 

Participants expected to: 

  • Treat all participants, instructors, and staff with respect 
  • Follow retreat schedule and guidelines 
  • Respect venue rules and local customs 
  • Participate in activities safely and responsibly 
  • Refrain from disruptive or inappropriate behavior 


14.2 Prohibited Behavior 

Following behaviors prohibited: 

  • Harassment, discrimination, or bullying of any kind 
  • Illegal drug use 
  • Excessive alcohol consumption that disrupts retreat experience 
  • Behavior that endangers self or others 
  • Violation of local laws or customs 


14.3 Removal from Retreat 

ELE reserves right to remove any participant who: 

  • Violates code of conduct 
  • Engages in unsafe or illegal behavior 
  • Disrupts retreat experience for others 

No refund provided for participants removed due to code of conduct violations. You agree not to hold ELE liable for actions taken under these terms. Any transportation, possession, or use of illegal drugs will result in immediate termination of trip and may result in prosecution. 


15. PHOTOGRAPHY AND MEDIA RELEASE 


15.1 Photo and Video Usage 

By participating in ELE retreats, you grant permission for: 

  • Photography and videography during retreat activities 
  • Use of your image in marketing materials, website, and social media 
  • Testimonials and feedback to be shared publicly (with your approval) 


15.2 Opt-Out Option 

Participants who do not wish to be photographed or have images used in marketing must notify us in writing prior to retreat start date at info@embodyluxeexperiences.com. 


15.3 Personal Photography 

Participants welcome to take personal photos during retreats. We ask that you: 

  • Be respectful of other participants' privacy preferences 
  • Do not post photos of other participants on social media without permission 
  • Follow venue photography rules and restrictions 


16. AIR TRAVEL AND TRANSPORTATION 


16.1 Airline Tickets 

Your airline ticket is contract between you and air carrier, even if purchased through ELE. ELE does not have right to control operations of independent airlines and is not liable for any personal injury, property damage related to purchase of air tickets or air travel, including but not limited to any act, error, omission, injury, loss, accident, or delay caused by airline. 


16.2 Agency for Air Travel 

ELE functions solely and exclusively as booking agent for air carrier. ELE does not handle or hold client funds for airline tickets and is not Merchant of Record. Because ELE does not hold client funds, any refund for canceled or delayed flights, baggage fees, or seat assignments must come directly from airline, not from ELE. 


16.3 Check-In Requirements 

Strongly recommended to check in minimum 2 hours prior to scheduled departure for domestic flights and 3 hours prior for international flights. Reconfirm flight times at least 24 hours prior for domestic flights and 72 hours prior for international flights. 


16.4 Frequent Flyer and Seat Assignments 

Frequent flyer mileage accrual at discretion of airline(s). ELE has no liability if accrual of miles denied or upgrades not allowed. Seat assignments not guaranteed even after assigned. ELE has no control over airline seat assignments. Most airlines charge fee to pre-book seat. 


17. INTELLECTUAL PROPERTY 


17.1 Ownership 

All content on www.embodyluxeexperiences.com including text, graphics, logos, images, videos, and software is property of ELE, MPS Creations LLC, or TheTeacherChelsea LLC and protected by copyright and trademark laws. 


17.2 Permitted Use 

You may: 

  • View and download content for personal, non-commercial use 
  • Share website links on social media 
  • Print materials for personal reference 


17.3 Prohibited Use 

You may NOT: 

  • Reproduce, distribute, or sell website content without written permission 
  • Use our trademarks, logos, or branding without authorization 
  • Copy or distribute retreat curriculum, training materials, or proprietary flexology methods 


18. FORCE MAJEURE 


18.1 Definition 

Force Majeure events include but not limited to: 

  • Natural disasters (earthquakes, hurricanes, floods, volcanic eruptions) 
  • Pandemics or health emergencies 
  • Government restrictions or travel bans 
  • Acts of terrorism or war 
  • Venue closure or unavailability beyond our control 
  • Extreme weather events 


18.2 ELE's Rights 

In event of Force Majeure, ELE may: 

  • Cancel or postpone retreats without liability 
  • Modify retreat location or itinerary 
  • Offer alternative retreat dates or credit toward future retreats 


18.3 Participant Rights 

If retreat cancelled due to Force Majeure: 

  • Full credit toward future retreat within 18 months, OR 
  • Refund of payments made minus non-recoverable costs (venue deposits, vendor fees) 
  • ELE not liable for participant expenses (flights, accommodations) that cannot be recovered 

THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS. 


19. LIMITATIONS OF RESPONSIBILITY 


19.1 Agency Status 

ELE acts solely as booking agent for disclosed principal Suppliers and is not source or provider of any travel service. Each Supplier is independent entity with its own management and not subject to control of ELE. Suppliers whose names appear in travel documentation are those responsible for providing travel services purchased. 


19.2 Supplier Alterations 

Supplier may determine alterations in itinerary necessary for any number of reasons, including severe weather. Any alterations at sole discretion of Supplier, and ELE bears no responsibility for changes. 


19.3 Disclaimer of Liability 

BECAUSE ELE ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE RIGHT TO CONTROL OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT ELE IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE ARISING OUT OF THESE SERVICES. 

ELE HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER. 


19.4 Recovery Limitation 

ELE HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM ELE WILL BE LIMITED TO AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY ELE. 


20. PRIVACY POLICY 


20.1 Information Collection 

We collect personal information including: 

  • Name, email address, phone number 
  • Billing and payment information 
  • Health and emergency contact information 
  • Travel preferences and dietary restrictions 


20.2 Information Use 

We use your information to:

20.5 Your Rights 

You have right to:

  • Opt-out of marketing communications 
  • Request deletion of information (subject to legal requirements) 


21. INDEMNIFICATION 

You agree to indemnify and hold harmless ELE, MPS Creations LLC, TheTeacherChelsea LLC, and their respective employees, contractors, and partners from any claims, damages, losses, or expenses (including legal fees) arising from: 

  • Your violation of these Terms and Conditions 
  • Your violation of any law or rights of third parties 
  • Your participation in retreat activities 
  • Your use of website 

When you book with ELE, you accept responsibility for any damage or loss caused by you. Full payment for such damage or loss must be paid directly at time to accommodation owner, manager, or other Supplier. 


22. DISPUTE RESOLUTION 


22.1 Governing Law 

These Terms and Conditions governed by laws of State of Michigan, United States, without regard to conflict of law principles. 


22.2 Jurisdiction 

Any disputes arising from these Terms and Conditions or retreat participation shall be resolved in courts of Wayne County, Michigan. You hereby consent to exclusive jurisdiction and venue of courts in Wayne County, Michigan. 


22.3 Informal Resolution 

Before filing legal action, parties agree to attempt informal resolution through direct communication and good-faith negotiation. 


22.4 Mediation 

If informal resolution fails, parties agree to participate in mediation in Michigan before pursuing litigation. Mediation costs split equally between parties. 


23. GENERAL PROVISIONS 


23.1 Modifications to Terms 

ELE reserves right to modify these Terms and Conditions at any time. Changes effective immediately upon posting to website. Updated versions posted at www.embodyluxeexperiences.com and effective immediately. Continued use of website or participation in retreats after modifications constitutes acceptance of revised Terms. 


23.2 Entire Agreement 

These Terms and Conditions, along with Privacy Policy and retreat-specific agreements, constitute entire agreement between you and ELE regarding use of website and retreat participation. 


23.3 Severability 

If any provision deemed invalid or unenforceable, remaining provisions continue in full force and effect. 


23.4 Right to Correct Errors 

ELE reserves right to correct errors. In event of pricing error or omission, ELE reserves right to adjust pricing or make corrections. All offers, incentives, and Supplier promotions subject to availability and may change without notice. 


23.5 Currency Fluctuations 

Currency exchange rates fluctuate. Prices subject to change based upon currency exchange rate fluctuations. ELE not responsible for surcharges or foreign transaction fees imposed by Client's credit card or bank. 


23.6 Unused Arrangements 

When retreat prices based on Suppliers' contract rates, you not entitled to refund for unused portion of travel.

By using this website and/or booking a retreat, you acknowledge that: 

  • You have read and understood these Terms and Conditions 
  • You agree to be bound by these terms 
  • You are at least 25 years of age or have received special approval 
  • All information you provide is accurate and complete 
  • You understand ELE acts solely as booking agent for disclosed principal Suppliers 
  • You acknowledge risks associated with retreat activities and travel
